Folbig was jailed in 2003 on murder charges. Four of her children, Caleb, Patrick, Sarah, and Laura, had died between 1989 and more than a decade apart. He was considered a suspect in the case. However, there was no physical evidence that she caused his death. According to the BBC report, Folbig always claimed his innocence. Each child died suddenly between 1989 and 1999, aged between 19 days and 19 months. The prosecution alleged that Folbig had strangled her. A 2019 investigation found no grounds to suspect Folbig. In the original trial, more weight was given to circumstantial evidence.

In a fresh inquiry chaired by retired judge Tom Bathurst, prosecutors acknowledged that research into gene mutations had changed their understanding of the children’s deaths. After a year-long campaign to free Folbig, she was granted a pardon when a team of immunologists discovered that her children had a genetic mutation that can cause sudden death. Evidence also emerged that their sons had a different genetic mutation, which in mice was associated with sudden-onset epilepsy. Based on this report, the woman was acquitted.
