Maharashtra Political Crisis: The political tussle going on in Maharashtra for the last several months may end soon. The Supreme Court will give its verdict on the suspension of 16 rebel MLAs of Shiv Sena on Thursday (May 11). Last year in June 2022, Eknath Shinde and his faction’s MLAs rebelled against the Shiv Sena.
The Uddhav Thackeray group had filed a petition against the rebel MLAs with the Deputy Speaker to disqualify the MLA. However, 16 MLAs including Eknath Shinde filed a petition in the Supreme Court against the decision of the Vice President and demanded a stay. The Eknath Shinde faction says that some MLAs have already brought a motion of no confidence on the Vice President, so they cannot take a decision on the suspension of the MLAs.
After a long hearing in the Supreme Court for about 9 months, the Supreme Court has reserved its decision after hearing the arguments of both the sides.
What is the claim of the Thackeray group?
The lawyers of the Thackeray group argued in the Supreme Court, citing Article 10 of the Constitution, if a group of legislators revolts by more than two-thirds. So they will have to merge in one or the other party. But Shinde and his group did not do this. Therefore he should be disqualified. The same Thackeray group called the question raised on the mistrust on the Deputy Speaker of the Legislative Assembly wrong.
Shinde faction claims
During the hearing in the Supreme Court, the lawyers of the Shinde faction said that their MLAs did not revolt in the party, they are still in the Shiv Sena and were in the Shiv Sena earlier also. Therefore, citing the Tenth Schedule of the Constitution, the demand for expulsion is being made, it is devoid of facts. Eknath Shinde is the group leader in the Legislative Assembly of the Shiv Sena party. He has the majority, so Uddhav Thackeray tried to remove the MLAs illegally without completing the quorum.

The Supreme Court cannot directly take any decision on the suspension of MLAs. It can be considered interference in the functioning of the executive ie the assembly. Legal experts say that the Supreme Court can send the case to the Speaker of the Legislative Assembly to disqualify the MLAs.
