The Fact India: Delhi’s Rouse Avenue Court has approved Congress leader Rahul Gandhi’s plea for issuance of a new passport. Rahul Gandhi will get a new passport for three years. In the hearing on this matter on Friday, the court has said that the No Objection Certificate (NOC) of the court will be valid only for three years. Rahul Gandhi had surrendered his diplomatic passport after his membership of Parliament was canceled in the defamation case. He demanded that a new passport be issued.
Subramanian Swamy opposed Rahul’s plea saying that Rahul has demanded a passport valid for 10 years. This is very high. But this is a very special case. Passport is not a fundamental right. Rahul has no valid reason to ask for passport for 10 years. Passport should be given only for one year and after that it should be reviewed.
Subramaniam said in the court that recently I had gone to Britain. An official there told me that Rahul Gandhi has declared himself a British citizen. According to Indian laws, his Indian citizenship should be terminated outright. On Subramaniam’s plea, the court said that Swamy is not saying that passport should not be given to Rahul Gandhi. All they are saying is that they should be given passport for one year.
Rahul Gandhi’s lawyer Cheema argued in the court that giving passport for 10 years is a routine arrangement. There is no issue of trouble regarding citizenship. Those with more serious charges were also given passports for 10 years. This also includes cases like 2G. While granting bail in the defamation case, this condition was not kept that Rahul would have to inform the court before going abroad. On Cheema’s plea, the Rouse Avenue Court asked Rahul whether he would cooperate in the investigation.

After this, the court asked Subramaniam that Mr. Swamy, do you have anything to say on this argument of Rahul’s lawyer? On this, Subramaniam said that if something wrong has happened in the past, it should not be made a tradition.
Rahul Gandhi’s lawyer said in the court that no criminal action is pending against my client. It is their fundamental right to travel. In the National Herald case, the court granted bail to Rahul in 2015. Then the court did not impose any restriction on his travel. The court said that this matter is pending since 2018. During this, Rahul Gandhi has gone abroad many times. There is no possibility of his escape. It is their fundamental right to travel.
